Distance Sales Agreement

This agreement applies to service sales concluded electronically through airomeda.com, in accordance with Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

1.2 Buyer

The name/company, email, phone and billing address you provide at checkout form the Buyer details and are an integral part of this agreement.

2. Subject of the Agreement

The subject of this agreement is the sale and performance of the service ordered electronically by the Buyer through airomeda.com, whose characteristics and price are stated on the relevant package page.

The services sold are digitally delivered software development and IT services. There is no physical product delivery.

3. Service Characteristics and Price

  • The type, scope and deliverables of the service are listed on the published page of the purchased package.
  • The sale price is the amount shown in the order summary. Unless stated otherwise, prices are in US dollars (USD).
  • Any applicable taxes are shown separately in the order summary.
  • Listed prices remain valid until updated.

4. Payment

  • Payment is made in full by credit/debit card at the time of order (checkout).
  • Card transactions are processed through the Stripe payment infrastructure. Card details are not stored by the Seller.
  • For monthly service packages, the fee is charged automatically at the start of each billing period.
  • If payment is not completed, the Seller is not obliged to perform the service.

5. Performance of the Service

  1. After payment, the Seller sends the Buyer a scope document containing deliverables, timeline and assumptions.
  2. Performance begins upon mutual approval of the scope document.
  3. Delivery is made electronically within the period stated in the scope document.
  4. The Seller is not responsible for delays caused by the Buyer's failure to provide required content, access or approvals.

The statutory maximum performance period is 30 days from formation of the contract. If the scope document provides for a longer period, the Buyer's express consent is obtained.

6. Right of Withdrawal

The Buyer may withdraw from the contract within 14 days, without giving any reason and without penalty, before performance of the service has begun. In that case the full amount paid is refunded.

6.1 Where the Right of Withdrawal Does Not Apply

Under Article 15 of Law No. 6502 and Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for services whose performance has begun with the consumer's consent.

When the Buyer consents at checkout to immediate commencement of the service, and the scope document is approved and work has actually started, the right of withdrawal ends.

In that case, under the Refund and Cancellation Policy, the remaining balance is refunded after deducting completed work and non-recoverable third-party costs.

6.2 Notice of Withdrawal

To exercise the right of withdrawal, send written notice to hello@airomeda.com before the period expires, stating your order number.

The amount is refunded to the card used for payment within 14 days of the Seller receiving the notice.

7. Defective Service

If the delivered service does not conform to the scope document, the Buyer may request free correction by giving notice within 14 days of delivery. If the non-conformity cannot be remedied within a reasonable time, the Buyer may request a refund of the price of the affected item.

The Buyer's statutory rights under Law No. 6502 are reserved.

8. Dispute Resolution

For disputes arising from this agreement, Consumer Arbitration Committees at the Buyer's place of residence or where the transaction took place have jurisdiction within the monetary limits announced by the Ministry of Trade; above those limits, Consumer Courts have jurisdiction.

For Buyers who are not consumers, the laws of the United Arab Emirates apply and the courts of Ajman have jurisdiction.

9. Entry Into Force

By confirming the order, the Buyer declares that they have read, understood and accepted all terms of this agreement. The agreement enters into force upon confirmation of the order by the Seller.

A copy of the agreement is sent to the Buyer's email address together with the order confirmation.
